As you may be aware, from 25 May 2018 the General Data Protection Regulation (GDPR) will impose greater data protection obligations on organisations whilst giving more rights to individuals in relation to how their personal data is processed. It also requires organisations to provide information about their processing in a clear and transparent way.
Personal data is anything that can identify you as a living individual.

How do we collect your personal data?

  1. Through our web site enquiry form.
  2. By you getting in touch with us – by phone, face to face, by post, providing a business card.
  3. Taking site photographs – geo-location may be present (only when you give consent).
  4. Through a representative of the client/prospective client.
  5. Via openly available public sources (e.g. company web sites)

What personal data are we collecting?

  1. Name, company name, job title, postal address, phone number, email address, mobile number
  2. Bank details if relevant
  3. Geo-location based on site (photographs - only went the client gives consent)

How do we use your data and on what basis?

  1. To answer a sales enquiry, in fulfilment of a contract or provision of our services. This is carried out based on the performance of a contract or agreement.
  2. Bank details are taken to allow for payment for agreed goods or services as part of a contract.
  3. Photographs are taken of the site in fulfilment of a response to tender and/or during the fulfilment of a contract (with your consent (permission)) only).
  4. For legal purposes as required.
  5. We may wish to keep you informed about our services or projects which we believe will be of interest to you, this is done based on our legitimate business interests. You can opt out of these communications at any time by contacting our DPO – contact details shown above.  Please entitle your communication Marketing Communications opt out. Please note that this should not impact the communication required in the fulfilment of a contract, enquiry or other business communications.

Sharing Your data

Personal data is not shared with any third parties for them to use for their own marketing purposes. We may share your data as follows:

  1. In the fulfilment of a contract, enquiry or tender process where contact details MAY need to be provided for costing of or for the provision of goods and services. Please note that we only work with trusted partners.
  2. We are legally required to do so.
  3. You have requested us to do so.
  4. When we are working with our professional services providers – such as accountants and solicitors.

When you give us information about another person you need to confirm that you have been appointed to act on behalf that other person.  This includes providing their consent to process that other person’s data as set out in this document. This consent needs to be provided in writing by the person you are representing.


Individuals’ rights

The GDPR gives you rights over your data.

  1. What information do we hold on you - Personal information will be held by us in both paper form and on our IT systems and will be kept in line with our retention policy.  If you would like a copy of the information we hold about you, you can make a subject access request. Please write to: The Data Protection Officer, contact details shown above, entitling your enquiry Subject Access Request.  Please ensure you provide your current contact details and sign your request. The GDPR states that we may require further proof of identity before this information is released to you. We will endeavour to respond to you as soon as possible, at most within one calendar month.
  2. Corrected or Deleted - Rights in certain circumstances to have inaccurate personal data corrected, deleted or destroyed. With that in mind please do keep us up to date with any change in your contact details. Any changes should be sent to DPO@bowleswyer.co.uk providing both your old and new contact details.  You should also ensure (if relevant) that your bank details are kept up to date. Please entitle the communication Change contact details. However, if you require us to delete your details, please entitle the communication Delete Contact Details.
  3. Stop processing for direct marketing - Right to stop processing for direct marketing. Right to claim compensation for damages caused by breach of the act. Right to object to processing that is likely to cause or is causing damage or distress.

In each instance if you wish to have us stop processing it for marketing purposes, claim compensation, or object to processing please write to: The Data Protection Officer – contact details shown above.  Please ensure you provide your current contact details, details of your request and ensure that your request is signed. If you could head your communication with the subject of your request that would be very helpful.


Data Security/safeguards

Bowles and Wyer take the protection of your personal data very seriously and we take appropriate steps to ensure your personal data is stored in a secure environment to prevent any unauthorised access. Bowles and Wyer may need to share your personal data with third parties. When we do so we have appropriate agreements in place to protect the data. Any personal information sharing between third parties and ourselves are conducted by secure means.
